1. About these terms

These Terms govern use of flamepebble.com and purchases from FlamePebble. FlamePebble is operated by HONG KONG XUTONG TRADING CO.,LIMITED, a company incorporated in Hong Kong.

By using the store or placing an order, you agree to these Terms and the policies incorporated by reference. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under the consumer law applicable to you.

2. Eligibility and acceptable use

You must be at least the age of legal majority in your jurisdiction to place an order. You must not misuse the store, interfere with its security, introduce harmful code, scrape it unlawfully, infringe intellectual-property rights, or use it for fraudulent or illegal activity.

3. Product information and handmade variation

We aim to describe and photograph products accurately. Colors may vary between displays. Handmade glass may include reasonable differences in shape, dimensions, markings, bubbles, and color. Such disclosed handmade variation is not a defect, but statutory rights apply if goods are materially misdescribed, faulty, unsafe, or not of the quality required by law.

Product measurements, materials, processing estimates, safety information, and customization details on the product page form part of the offer.

4. Orders and contract formation

Submitting an order is an offer to purchase. An automated acknowledgment confirms receipt but does not necessarily mean the order has been accepted. Acceptance occurs when we expressly confirm acceptance or dispatch the order, subject to applicable law.

We may reject or cancel an order for genuine reasons such as payment failure, suspected fraud, pricing or listing error, unavailability, regulatory restriction, inability to ship, or an unsafe or infringing custom request. If we cancel after payment, we will issue the appropriate refund.

5. Prices, currency, and payment

Prices and currency are displayed in the store or at checkout. Shipping, tax, and import treatment are shown where available. Currency-conversion rates and foreign-transaction fees may be set by the customer’s payment provider and are not controlled by us.

Payment must be authorized using an available checkout method. The customer must provide accurate billing, contact, and delivery information.

6. Processing, delivery, and risk

Processing and delivery are governed by our Shipping & Delivery Policy. Legal rules about delivery, risk of loss, and remedies for delay apply and are not displaced by a carrier scan or a provision of these Terms.

7. Cancellations, returns, and refunds

Our Returns & Refunds Policy and Custom & Personalized Order Policy apply. EU and UK consumers may have a statutory 14-day right to cancel eligible online purchases. Personalized products and unsealed hygiene-sensitive products may be exempt where the law permits.

8. Custom content

Customers must have the right to provide any photograph, artwork, name, text, or other material submitted for custom work. The limited license and privacy treatment for such material are described in our Custom Order and Privacy Policies.

9. Reviews and public submissions

If you voluntarily submit a review or public social-media content and separately authorize FlamePebble to reuse it, you grant the license described in that authorization. We will not treat private custom reference photographs as public marketing content without separate permission.

You must not submit unlawful, misleading, infringing, hateful, or malicious content. We may moderate content where lawful but are not required to publish every submission.

10. Intellectual property

The store, brand assets, original product designs, photographs, videos, text, graphics, and other original content are owned by or licensed to FlamePebble and are protected by applicable intellectual-property laws. No ownership right is transferred by purchase of a product. Content may not be commercially copied, reproduced, or exploited without written permission, subject to lawful exceptions.

11. Third-party services

The store may use or link to services operated by Shopify, payment providers, carriers, social networks, or other third parties. Their services may be governed by separate terms and privacy policies. We are responsible only to the extent imposed by applicable law for matters within our control.

12. Safety and proper use

Customers must follow the Product Safety, Materials & Care Guide and product-specific warnings. Products are fragile, may contain small parts, and are not toys. Do not use damaged glass or jewelry. These instructions do not exclude liability that cannot legally be excluded.

13. Disclaimer and limitation of liability

To the maximum extent permitted by law, we are not liable for losses that are not a reasonably foreseeable result of our breach, or for business losses arising from a consumer purchase. We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where applicable, unsafe products where liability cannot be excluded, or mandatory consumer guarantees.

14. Indemnity for misuse

To the extent permitted by law, a user is responsible for third-party claims arising from that user’s unlawful misuse of the store, infringement of third-party rights, or unauthorized materials submitted for custom work. This provision does not impose liability on a consumer beyond what applicable law permits.

15. Governing law and consumer rights

These Terms are governed by the laws of Hong Kong, without depriving a consumer of mandatory protections or access to courts that apply in the consumer’s habitual country of residence. Any dispute clause is subject to those mandatory rights.

16. Severability and changes

If part of these Terms is unenforceable, the remaining provisions continue to apply. We may update these Terms prospectively. Changes do not retroactively reduce rights under an order already accepted unless the law permits and the customer agrees where required.
